The Graphic Design Company - Terms of service

When choosing a Graphic Designer it is important to look at their portfolio and make sure their styles and abilities are what you are after. It is also important to make sure your chosen designer will provide you with the PDF files of your artwork and that you own your designs upon payment. It will save you a lot of money long term.


Below is an outline of our standard terms and conditions. Please take time to read through our terms and conditions thoroughly and ensure you understand them before you commence a project with us. By commencing work you are agreeing to our terms and conditions.


Extra work outside the original brief
Any additional work or variations outside of the original brief, will be charged at the rate of $80 per hour, charged in 15 minute increments. All prices exclude gst. Extra expenses will be charged accordingly. GST not included.


Payment
Half way through you project you will be invoiced for the total price. Upon payment, printing and website construction will be commenced. If your situation changes partway through your project please inform us and we will negotiate a percentage payment or payment plan. DO NOT ask us to design material for you with the intension that design is free. All prices include delivery and exclude gst. Payments are to be made within 30 days of invoicing. If payments are not received within 90 days, online websites will be deleted and copyrights to all design and printing will remain the ownership of The Graphic Design Company.
 

 

Guarantee
In the unlikely event you are not 100% Satisfied, we want you to tell us during the design process and you won’t pay a cent. We have this guarantee to give the client an assurance that The Graphic Design Company will deliver professional designs in a timely manner. If the clients original requirements change this guarantee is void. Please do not commence working with us if you do not intend on paying, or are looking for some free preliminary designs.
 

 

Approving Proofs/ Designs/Printing
When approving artwork proofs, you are held fully responsible for approving all content. This includes design, spelling, grammar and quantity. It is your responsibility to request another copy if your proof is difficult to read or if changes are required. Your final accepted proof is what will be printed. There will be no reprints at our expense. Print out your proof supplied at 100%, this will help you to confirm the colours, design, size and type size.
 

 

Submitting your own artwork
Customers who send in their own artwork are fully responsible for the end result of printing. Customers are reminded to submit print-ready artwork with the correct specifications. We will print whatever you submit, but take no responsibility for artwork mistakes. There will be no reprints at our expense.


Copyright
Artwork designed by The Graphic Design Company will remain the property of The Graphic Design Company until account is paid in full.  Future orders of the same printing product with same design will only incur a print management fee.
It is your responsibility to ensure that any design that is submitted does not violate Australian copyright laws. The Graphic Design Company and their designers will assume your artwork is legally yours. Upon full payment copyright ownership will be transferred to the account holder. The Graphic Design Company and their designers retain rights to use the artwork and all design elements within their portfolios. For more information visit http://www.copyright.org.au/information


Printing
Printing will not commence until full payment for design and printing is received. The current turnaround time for printing is 5-10 working days depending on the product. This is from the time of approval and payment to the time when you receive your order. Customers are reminded that when your artwork is trimmed, the bleed cut can vary in position up to 2-3mm, hence a 3mm internal margin from the bleed line is required if you are supplying your own artwork. With all printing there may be some colour variations from what you have seen on screen, to what the final product looks like, and previous orders. This is due to the nature of CMYK printing and bulk-run printing system. There will be no reprints at our expense.


Delivery
The Graphic Design Company can not be held liable for printing products that are damaged, lost or delayed when delivered by post or courier.


Website Design
The Client agrees to allow The Graphic Design Company to place a small credit on the customer's website. This will be in the form of a small line of text placed towards the bottom of the page.
The Client also agrees to allow The Graphic Design Company to place websites and other designs, along with a link to the client's site on The Graphic Design Companys own website for self promotional purposes.
Website design post- completion alterations:  Once your website is built The Graphic Design Company will provide the client with the opportunity to review the resulting work. We will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to The Graphic Design Company by e-mail. The Graphic Design Company will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review period.


SEO Search engine optimization & Search Engine Listings:
The Graphic Design Company build websites according to the trends of SEO at the time of building. We will help you to explore your key words/key phrases, but the final choice is up to the client.


The Graphic Design Company cannot be held responsible or guarantee:
if your website is not listed within Google or any other search engines listings, the position of your site in any search engines, which or if any of your pages will be listed in any search engines, the time it will take for any search engines to list your site and your choice of key words/key phrases.
If you are unhappy with your listings please make sure you have completed the steps out lined in our "helping yourself" worksheet.  Then contact us to arrange an evaluation of your website.
When we are supplied content for a website we assume that the content is written by the client and has not been copied from anyone or anything else. We take no responsibility for duplicate content found on the clients website or if the website is search engine black listed due to the written content or images of their site.

We do not provide the following services: Domain names, Hosting and registration, SSL certificates, Email addresses, Email hosting, Setup of email addresses, Emails errors of any kind and Email Signatures
The Graphic Design Company holds no responsibility if your email addresses are targeted with spam as it is out of our control. We hold no responsibility if your email account details are attained and used to send spam or malicious material.
The Graphic Design Company build and design websites to the best of their knowledge at the time of completion. We cannot take responsibility if your site is "hacked". We do not provide software updates or take responsibility if the software used becomes out of date and obsolete. The Graphic Design Company does not take responsibility for any unforeseen advancements in technology that may have negative effects on any aspects of your site or system.
CMS Content Management Systems: CMS Content Management Systems websites are signed over in an agreed working order. Any changes to the working files or configuration of the CMS that are done by anyone outside of The Graphic Design Company are the responsibility of the site owner. We build websites using the latest software available at the time. All website terms and conditions also apply to CMS.
The Graphic Design Company does not hold responsibility for any content posted the clients website. Any changes to the CMS after the sign over will be charged accordingly. Any repercussions of the advancements in the CMS or server/hosting technology are not the responsibly of The Graphic Design Company. The Graphic Design Company does not hold any responsibility for misuse of the CMS or website.


Amendments to these Terms and Conditions

All and any amendments to the terms and conditions outlined in this submission must be provided in writing and signed by an authorized representative of The Graphic Design Company prior to the commencement of work.
